Cosa fare: aggiornare PHP a 8.5.12, 8.4.27, 8.3.36 o 8.2.35 e verificare i siti.<\/span><\/li><\/ol><p><!-- \/wp:paragraph --><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-176a425b elementor-widget elementor-widget-heading\" data-id=\"176a425b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">1 Decreto AI Act 179\/2026: cosa cambia in Italia dal 23 ottobre<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3bce0708 elementor-widget elementor-widget-text-editor\" data-id=\"3bce0708\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">L&#8217;AI Act esiste dal 2024, ma finora in Italia mancava un pezzetto: <\/span><b>chi controlla e chi sanziona.<\/b><\/p><p><i><span style=\"font-weight: 400;\">Dal 23 ottobre 2026 quel pezzetto c&#8217;\u00e8.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Il decreto legislativo 179\/2026 non riscrive le regole europee: le rende <\/span><b>applicabili<\/b><span style=\"font-weight: 400;\">, con <\/span><b>autorit\u00e0<\/b><span style=\"font-weight: 400;\">, <\/span><b>procedure<\/b><span style=\"font-weight: 400;\"> e <\/span><b>multe<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Per le aziende significa che l&#8217;AI usata senza criterio smette di essere solo un problema teorico.<\/span><\/p><h3><span style=\"font-weight: 400;\">Cos&#8217;\u00e8 il decreto legislativo 179\/2026<\/span><\/h3><p><span style=\"font-weight: 400;\">Il decreto legislativo 7 ottobre 2026, n. 179 adegua la normativa italiana al <\/span><a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2024\/1689\/oj\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Regolamento UE 2024\/1689<\/span><\/a><span style=\"font-weight: 400;\">, cio\u00e8 l&#8217;AI Act. \u00c8 stato pubblicato nella <\/span><a href=\"https:\/\/www.gazzettaufficiale.it\/atto\/serie_generale\/caricaDettaglioAtto\/originario?atto.dataPubblicazioneGazzetta=2026-10-08&amp;atto.codiceRedazionale=26G00200&amp;elenco30giorni=false\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Gazzetta Ufficiale<\/span><\/a><span style=\"font-weight: 400;\"> il 7 ottobre, conta 54 articoli ed \u00e8 <\/span><b>in vigore dal 23 ottobre 2026.<\/b><\/p><p><span style=\"font-weight: 400;\">Attenzione a non confonderlo con il D.Lgs. 160\/2026:<\/span><b> sono due atti distinti<\/b><span style=\"font-weight: 400;\">, e il 179 \u00e8 il secondo decreto di adeguamento, con obblighi propri.<\/span><\/p><p><span style=\"font-weight: 400;\">Oltre a vigilanza e sanzioni, il testo <\/span><b>disciplina le sandbox regolatorie<\/b><span style=\"font-weight: 400;\"> (spazi controllati per sperimentare sistemi di AI), l<\/span><b>&#8216;uso dell&#8217;AI <\/b><span style=\"font-weight: 400;\">nel lavoro e la <\/span><b>formazione<\/b><span style=\"font-weight: 400;\"> nelle professioni regolamentate.<\/span><\/p><h3><span style=\"font-weight: 400;\">AgID e ACN: chi vigila sull&#8217;intelligenza artificiale in Italia<\/span><\/h3><p><span style=\"font-weight: 400;\">Il decreto affida i poteri nazionali di <\/span><b>vigilanza<\/b><span style=\"font-weight: 400;\"> e <\/span><b>sanzione<\/b><span style=\"font-weight: 400;\"> a due soggetti: <\/span><b>AgID <\/b><span style=\"font-weight: 400;\">(Agenzia per l&#8217;Italia Digitale) e <\/span><b>ACN<\/b><span style=\"font-weight: 400;\"> (Agenzia per la Cybersicurezza Nazionale). A coordinarli ci sono un punto di contatto unico e un comitato di coordinamento.<\/span><\/p><p><i><span style=\"font-weight: 400;\">Tradotto: da adesso esiste qualcuno che pu\u00f2 chiederti come usi l&#8217;AI e chiederti di dimostrarlo.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Per questo la<\/span><b> documentazione interna diventa importante<\/b><span style=\"font-weight: 400;\">: elenco degli strumenti usati, finalit\u00e0, chi li supervisiona e quale formazione \u00e8 stata fatta.<\/span><\/p><h3><span style=\"font-weight: 400;\">Sanzioni AI Act: fino a 35 milioni di euro o al 7% del fatturato<\/span><\/h3><p><span style=\"font-weight: 400;\">La sanzione massima arriva a 35 milioni di euro o al 7% del fatturato mondiale annuo, se superiore. Vale per le <\/span><b>pratiche vietate dall&#8217;articolo 5 dell&#8217;AI Act<\/b><span style=\"font-weight: 400;\">, come la manipolazione dei comportamenti o il social scoring.<\/span><\/p><p><i><span style=\"font-weight: 400;\">Non tutte le violazioni costano milioni.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Per quelle di scarsa offensivit\u00e0 o pericolosit\u00e0 il decreto prevede anche misure non pecuniarie al posto della multa.<\/span><\/p><p><span style=\"font-weight: 400;\">Il messaggio per\u00f2 \u00e8 chiaro: l&#8217;<\/span><b>AI Act ora morde.<\/b><\/p><h3><span style=\"font-weight: 400;\">Intelligenza artificiale e lavoro: le decisioni finali restano a una persona<\/span><\/h3><p><span style=\"font-weight: 400;\">Questa \u00e8 sicuramente la novit\u00e0 con l<\/span><b>&#8216;impatto pi\u00f9 immediato<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Se un&#8217;azienda usa l&#8217;AI nei processi che riguardano il <\/span><b>personale<\/b><span style=\"font-weight: 400;\">, la decisione finale su assunzione, modifica e cessazione del rapporto deve<\/span><b> spettare a una persona fisica<\/b><span style=\"font-weight: 400;\">. Lo stesso vale per <\/span><b>provvedimenti<\/b><span style=\"font-weight: 400;\"> disciplinari e valutazioni delle <\/span><b>prestazioni<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">L&#8217;AI pu\u00f2 quindi <\/span><b>aiutare<\/b><span style=\"font-weight: 400;\"> a selezionare un CV o a leggere dei dati, ma<\/span><b> non pu\u00f2 essere lei a decidere<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><i><span style=\"font-weight: 400;\">E la persona che decide deve avere un potere effettivo: un &#8220;ok&#8221; automatico messo sotto la scelta dell&#8217;algoritmo non basta.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Chi lavora con questi sistemi deve anche poter ricevere spiegazioni chiare sulle decisioni supportate dall&#8217;AI.<\/span><\/p><h3><span style=\"font-weight: 400;\">L&#8217;AI Act \u00e8 stato rinviato? Cosa cambia con il Digital Omnibus<\/span><\/h3><p><span style=\"font-weight: 400;\">No, o meglio: <\/span><b>solo in parte.<\/b><\/p><p><span style=\"font-weight: 400;\">Il Digital Omnibus, cio\u00e8 il Regolamento UE 2026\/1744 in vigore dal 27 luglio 2026, ha <\/span><b>spostato in avanti soprattutto gli obblighi sui sistemi ad alto rischio<\/b><span style=\"font-weight: 400;\">. Chi invia newsletter, DEM o email commerciali con <\/span><b>statistiche di apertura<\/b><span style=\"font-weight: 400;\"> deve aver aggiornato <\/span><b>informativa<\/b><span style=\"font-weight: 400;\">, <\/span><b>consensi<\/b><span style=\"font-weight: 400;\"> e sistemi di <\/span><b>revoca<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><h3><span style=\"font-weight: 400;\">Cos&#8217;\u00e8 un pixel di tracciamento<\/span><\/h3><p><span style=\"font-weight: 400;\">Un pixel di tracciamento \u00e8 un&#8217;immagine trasparente grande un solo punto dello schermo.<\/span><\/p><p><span style=\"font-weight: 400;\">Non sta dentro l&#8217;email: \u00e8 <\/span><b>ospitata su un server remoto<\/b><span style=\"font-weight: 400;\"> e si carica quando il messaggio viene <\/span><b>aperto<\/b><span style=\"font-weight: 400;\">. In quel momento <\/span><b>comunica a chi ha inviato l&#8217;email che qualcosa \u00e8 successo<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">Secondo il Garante, a seconda dei casi il pixel pu\u00f2 raccogliere<\/span><b> indirizzo IP<\/b><span style=\"font-weight: 400;\">, <\/span><b>dispositivo<\/b><span style=\"font-weight: 400;\"> usato, <\/span><b>tempo di lettura<\/b><span style=\"font-weight: 400;\"> e numero di <\/span><b>aperture<\/b><span style=\"font-weight: 400;\">. Pu\u00f2 anche rilevare se il messaggio \u00e8 stato <\/span><b>cancellato<\/b><span style=\"font-weight: 400;\">, <\/span><b>inoltrato<\/b><span style=\"font-weight: 400;\"> o <\/span><b>archiviato<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><i><span style=\"font-weight: 400;\">Se non lo sapessi, si tratta del meccanismo dietro quasi tutte le statistiche di apertura delle piattaforme di email marketing.<\/span><\/i><\/p><h3><span style=\"font-weight: 400;\">Cosa prevede il provvedimento 284\/2026 del Garante<\/span><\/h3><p><span style=\"font-weight: 400;\">Le linee guida sono state adottate con il <\/span><a href=\"https:\/\/www.garanteprivacy.it\/home\/docweb\/-\/docweb-display\/print\/10241943\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">provvedimento n. 284 del 17 aprile 2026<\/span><\/a><span style=\"font-weight: 400;\"> e pubblicate nella Gazzetta Ufficiale n. 98 del 29 aprile 2026. Il termine di sei mesi per adeguarsi \u00e8 <\/span><b>scaduto il 29 ottobre 2026<\/b><span style=\"font-weight: 400;\">, come il Garante ha ricordato nel comunicato del 5 ottobre.<\/span><\/p><p><span style=\"font-weight: 400;\">Il punto centrale \u00e8 l&#8217;inquadramento giuridico. Il Garante tratta il pixel come un<\/span><b> accesso al dispositivo dell&#8217;utente<\/b><span style=\"font-weight: 400;\">, regolato dall&#8217;articolo 122 del Codice privacy: la stessa logica dei <\/span><b>cookie<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><i><span style=\"font-weight: 400;\">In linea generale, quindi, l&#8217;uso \u00e8 vietato senza consenso preventivo, salvo alcune eccezioni.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">Le linee guida chiariscono anche i ruoli. <\/span><b>Chi decide finalit\u00e0 e mezzi del tracciamento \u00e8 titolare del trattamento<\/b><span style=\"font-weight: 400;\">, anche se la<\/span><b> parte operativa \u00e8 affidata a una piattaforma esterna<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><i><span style=\"font-weight: 400;\">In poche parole: l&#8217;informativa sul tracciamento va data sempre, qualunque sia il tipo di email e chiunque sia il mittente, pubblico o privato.<\/span><\/i><\/p><h3><span style=\"font-weight: 400;\">Consenso ai tracking pixel nelle newsletter: come raccoglierlo<\/span><\/h3><p><span style=\"font-weight: 400;\">La buona notizia \u00e8 che non servono due caselle. Il consenso al tracciamento pu\u00f2 essere <\/span><b>raccolto insieme a quello per ricevere comunicazioni promozionali<\/b><span style=\"font-weight: 400;\">. Il testo dell&#8217;opt-in per\u00f2 deve dirlo in modo <\/span><b>esplicito<\/b><span style=\"font-weight: 400;\"> e neutro:<\/span><b> un consenso alla newsletter che non nomina il tracciamento non copre il tracciamento.<\/b><\/p><p><span style=\"font-weight: 400;\">Per gli<\/span><b> iscritti che hai gi\u00e0<\/b><span style=\"font-weight: 400;\">, le linee guida chiedono di <\/span><b>introdurre<\/b><span style=\"font-weight: 400;\"> e <\/span><b>comunicare<\/b><span style=\"font-weight: 400;\"> un meccanismo per revocare il consenso, anche solo per il tracciamento. \u00c8 la parte <\/span><b>pi\u00f9 difficile dal punto di vista tecnico<\/b><span style=\"font-weight: 400;\">: la piattaforma deve saper inviare a un singolo contatto email senza pixel e senza link tracciati.<\/span><\/p><h3><span style=\"font-weight: 400;\">Quando i pixel di tracciamento non richiedono consenso<\/span><\/h3><p><span style=\"font-weight: 400;\">Il Garante prevede alcune <\/span><b>eccezioni<\/b><span style=\"font-weight: 400;\"> in cui il pixel pu\u00f2 essere usato senza consenso specifico:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">statistiche in forma aggregata;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">finalit\u00e0 di sicurezza;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">esigenze tecniche strettamente necessarie;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">comunicazioni dovute, istituzionali o di servizio.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Anche in questi casi valgono proporzionalit\u00e0 e minimizzazione dei dati. Il Garante raccomanda inoltre<\/span><b> misure di privacy by design<\/b><span style=\"font-weight: 400;\">, per esempio evitare che l&#8217;indirizzo email del destinatario viaggi nella richiesta generata dal pixel.<\/span><\/p><h3><span style=\"font-weight: 400;\">Ispezioni del Garante e checklist per l&#8217;email marketing<\/span><\/h3><p><span style=\"font-weight: 400;\">La scadenza non \u00e8 solo formale. Con il provvedimento n. 545 del 23 luglio 2026 il Garante ha inserito la verifica di queste linee guida nel<\/span><b> piano ispettivo di agosto-dicembre 2026<\/b><span style=\"font-weight: 400;\">. I controlli, quindi, sono gi\u00e0 in calendario.<\/span><\/p><p><span style=\"font-weight: 400;\">Se non l&#8217;hai ancora fatto,<\/span><b> ecco da dove partire:<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Verifica se la tua piattaforma di invio usa pixel e link tracciati, e quali opzioni ha rilasciato per adeguarsi.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Aggiorna l&#8217;informativa privacy con una sezione dedicata ai tracking pixel: funzionamento, dati raccolti, finalit\u00e0, base giuridica, conservazione e revoca.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Modifica il modulo di iscrizione alla newsletter citando esplicitamente il tracciamento.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Comunica agli iscritti attuali come revocare il consenso al tracciamento.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Controlla che la piattaforma possa escludere dal tracciamento i singoli contatti che lo chiedono.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rivedi i KPI: se una parte degli iscritti non \u00e8 pi\u00f9 tracciata, il tasso di apertura cambia significato.<\/span><\/li><\/ul><p><i><span style=\"font-weight: 400;\">L&#8217;ultimo punto conta pi\u00f9 di quanto sembri. <\/span><\/i><span style=\"font-weight: 400;\">Una newsletter si misura su click, risposte e conversioni, non solo sulle aperture.<\/span><\/p><p><!-- \/wp:paragraph --><\/p><p><!-- \/wp:paragraph --><\/p><p><!-- <\/span><b>vulnerabilit\u00e0 critiche<\/b><span style=\"font-weight: 400;\"> che permettono di <\/span><b>eseguire codice da remoto<\/b> <b>sui server non aggiornati<\/b><span style=\"font-weight: 400;\">. Non \u00e8 la falla di un plugin qualsiasi: \u00e8 il linguaggio su cui gira gran parte dei siti, WordPress compreso.<\/span><\/p><h3><span style=\"font-weight: 400;\">Cosa sono le vulnerabilit\u00e0 PHP2Shell<\/span><\/h3><p><span style=\"font-weight: 400;\">PHP2Shell \u00e8 il nome dato a due vulnerabilit\u00e0 del motore di PHP, CVE-2026-109618 e CVE-2026-109619. Entrambe hanno un punteggio CVSS v4.0 di 9.2 su 10 e permettono a un <\/span><b>attaccante non autenticato di eseguire codice sul server<\/b><span style=\"font-weight: 400;\">, con i privilegi del processo web.<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>CVE-2026-109618<\/b><span style=\"font-weight: 400;\"> si attiva quando PHP esaurisce la memoria mentre prepara una richiesta. Alcuni dati restano costruiti a met\u00e0 e il codice di pulizia li tratta come validi, aprendo la strada all&#8217;esecuzione di codice.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>CVE-2026-109619<\/b><span style=\"font-weight: 400;\"> nasce da informazioni che sopravvivono alla fine di una richiesta, dopo che la memoria che le conteneva \u00e8 stata liberata. Se lo stesso processo gestisce una richiesta successiva, pu\u00f2 leggere quei dati non pi\u00f9 validi.<\/span><\/li><\/ul><p><i><span style=\"font-weight: 400;\">La tempistica ha peggiorato le cose.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">I dettagli sono trapelati online il 20 ottobre, un giorno prima delle patch. Secondo Datadog, AWS ha rilevato tentativi di sfruttamento gi\u00e0 dal 17 ottobre. Il 26 ottobre l&#8217;agenzia americana CISA ha inserito entrambe le falle nel catalogo delle vulnerabilit\u00e0 sfruttate attivamente.<\/span><\/p><h3><span style=\"font-weight: 400;\">Quali server e siti sono esposti (WordPress incluso)<\/span><\/h3><p><span style=\"font-weight: 400;\">\u00c8 esposta<\/span><b> qualsiasi installazione PHP che risponde a richieste web<\/b><span style=\"font-weight: 400;\">, a prescindere dal sito o dall&#8217;applicazione che ci gira sopra. Sono coinvolti PHP-FPM, Apache con mod_php (secondo PHP il caso a rischio pi\u00f9 alto), php-cgi, FrankenPHP e LiteSpeed.<\/span><\/p><p><i><span style=\"font-weight: 400;\">Quindi s\u00ec: WordPress, WooCommerce, gestionali e API scritte in PHP sono tutti interessati, se il server non \u00e8 aggiornato.<\/span><\/i><\/p><p><span style=\"font-weight: 400;\">E il login del sito non protegge: PHP elabora la richiesta malevola prima che entri in gioco qualsiasi codice dell&#8217;applicazione.
